Legislation-related RULE OF LAW RISK ASSESSMENT
A foundational component of a risk assessment programme of legal compliance is the audit of legislation and sub-ordinate texts thought to pose a risk of non-compliance against requirements of the Rule of Law (ROL)
This should be a first step that is baked into any legal risk assessment programme, because the risk of spending time, resources and infrastructure on complying with legislation and administrative orders that themselves are not compliant with the ROL may well consume resources that are not necessary to spend.
A ROL audit of legislation should therefore be a necessary starting point to minimise the risk of expenditure on compliance with legal requirements that do not in fact pose a legal risk
