Legislation-related RISK ASSESSMENT
Correctly identifying legislation for inclusion in a legal register is the first step towards developing and maintaining an effective and cost-effective programme to that guard against the risk of legislation-related loss eventuation.
However, the failure to identify a person or entity as a potential transgressor of legislation is common, and lessens the effectiveness of legislation-related compliance and transgression-monitoring programmes because it increases the risk of legislation-related loss. Wrongly identifying a person or entity as a potential transgressor of legislation is also common, and increases the costs of and without increasing the cost-effectiveness of these programme.
These errors occur perhaps because these programmes are usually developed, implemented and maintained by technical experts and consultants who, although knowledgeable about particular activities and operations and a particular related set of relevant legislation, are not actually trained in legislation and its analysis.
