One of the most common statements of the Rule of Law, thrown up by a Google search:
“The Rule of Law, in its most basic form, is the principle that no person is above the law.”
We need to fix this, because it describes the Rule of Law as an outcome, rather than as a set piece strategy that would reasonably, logically and rationally result in that outcome.
Consider the following:
“The principles upon which the rule of law is based, would ensure that no person is above the law”.
See the difference? The first is not testible. The second is a hypothesis in the form of “if … then” capable of being tested.
